Kelley issued new permit

Saratoga resident Royce Kelley’s response to the Planning Commission’s cease and desist order was to get a new building permit.

Kelley sought a permit for a mobile home being constructed on his property, a building permit Saratoga’s zoning officer Chuck Bartlett issued.

Kelley approached the Planning Commission Aug. 16 with questions about building permits and announced his newly issued building permit.

Planning Commission members questioned the legality of building a mobile home on the property. Bartlett told commission members the property is RD 6000, and it is legal to build a mobile home in that zoning area.

“If you want to build a mobile home on-site, that’s perfectly legal,” Bartlett said.

However, Kelley was asked to pay a fee for a meter pit and water and sewer tap fees. Town ordinance states the water and sewer tap fees and the fee for the water meter must be paid at the time a building permit is issued.

Kelley requested to wait to pay those fees until a later date because a third party invested a lot of money into the project.

“Any construction project is a major investment and that’s part of the investment,” said Planning Commission member Chris Shannon.

The Planning Commission requested Kelley pay the fees as soon as possible.

Planning Commission members were also curious as to where the mobile home was being moved to.

Bartlett said a mobile home can be moved to any designated area.

“It is staying on-site for right now,” Bartlett said. “If the guy ever decides to move, he can take his house with him.”

However, Kelley stated in the meeting there was an individual investing in the construction of the mobile home.

Planning Commission member Bob Thrasher started questioning the legality of building a structure to sell. However, Bartlett addressed Thrasher’s concerns.

Bartlett said there is no difference between Kelley’s operations and any other contractor building on residential property for money.

“The property owner came in and got the building permit for Royce to build the mobile home on-site,” Bartlett said. “What’s the difference between Chris or Rory building a house for somebody in the same situation?”

Chairman of the Planning Commission Rory Grubb said he wanted to make sure Kelley was not using his property as a staging area for multiple building projects.

In other business:

• The Planning Commission discussed revising its bylaws. Shannon made a motion the Planning Commission begin the process of revising the bylaws, but the motion did not pass.

• The Planning Commission continued its conversation in revising its ordinances relating to special use permits and zoning. Shannon said he would draft an ordinance for review at the next Planning Commission meeting.
