Clock ticks on block 11 agreement

Town waiting on their attorney, according to mayor.

On Jan. 4, the town of Saratoga and Randy Stevens were back in court on a default motion filed by Stevens.

The town and Stevens have been back and forth in court for the last four years concerning the property Stevens owns on block 11, near the corner of River St. and Maple Ave.

In the Jan. 9 edition of the Saratoga Sun, it was reported that prior to going before the judge, attorneys for the two parties settled on a tentative deal that is contingent on both sides signing the agreement.

As of Friday, Randy Stevens had approved the agreement through his attorney, but Mayor John Zeiger had not.

“I haven’t seen the agreement from the attorney,” Zeiger said in an interview Friday.

“I thought it was a workable solution,” Zeiger added.

Richard Rideout, of Cheyenne, is the attorney representing the town.

Rideout did not return a phone call Monday.

Zeiger said he was a bit concerned that he had not received the agreement yet.

According to Stevens, who received the agreement three weeks ago, there is a time factor to be met in order for both sides to fulfill the agreement.

Zeiger stated that he was concerned with the time factor also, and he had talked with Rideout two weeks ago. As of Friday, Zeiger said he was still waiting to receive the papers.

“It is a win-win for both sides,” Zeiger said. He added that he was at a loss as to why he hadn’t received the agreement yet.

According to the agreement Stevens shared with the Sun two weeks ago, the town has until May 30, 2013 to reconstruct the alleyway adjacent to lots one through 10 of block 11, including the removal of the existing sheer piling retaining wall.

The agreement also states “in no event, shall the May 30, 2013 reconstruction deadline be extended.”
