INVITATION TO BID Notice is hereby given that the Saratoga Cemetery District (hereinafter called Owner) will receive sealed Bids for the 2009 Cemetery Maintenance Building Project, in accordance with the Bidding Documents. Bids will be received by the Owner until 1:00 p.m. Local Time, the 4th day of June, 2009, at the Saratoga Town Hall, 110 E. Spring Avenue, P.O. Box 486, Saratoga, WY 82331. Bids will be publicly opened. The work shall consist of furnishing and installing a 30’ x 50’ pole barn type building and other related work. The Owner may reject any and all Bids and reserves the right to waive minor irregularities in any Bid. Each Bid must be accompanied by Bid Security payable to the Saratoga Cemetery District for 5% of the total amount of the Bid, to be forfeited to the Owner as liquidated damages if the Bidder is awarded the Contract and fails to enter into an Agreement with the Owner within thirty (30) days from his notification. All Bids shall remain open for forty–five (45) days after the day of the Bid opening. The successful Bidder shall perform the Work and furnish a Performance Bond and a Payment Bond, each in the amount of 100% of the contract price with a corporate surety approved by the Owner. The Contractor shall guarantee all materials and equipment furnished and work performed for a period of one year from the date of final acceptance. The Performance Bond shall remain in full force and in effect through the guarantee period. The Notice to Proceed shall be issued within thirty (30) days of the execution of the Agreement by the Owner. If the Notice to Proceed is not issued within this period, this period may be extended by mutual agreement between the Owner and the Contractor. If the Notice to Proceed has not been issued within the thirty (30) day period or within any mutually acceptable extension thereof, the Contractor or the Owner may terminate the Agreement on written notice to the other party, and in such case, there shall be no liability under the Agreement or otherwise on the part of either party. Contracts will be awarded to the lowest Bidder who has met the minimum requirements set forth in Article 3, Instructions to Bidders, and who is determined to be responsible in the sole discretion of the governing body. Resident Wyoming laborers, workmen and mechanics shall be used upon all work in this contract whenever possible. Preference is hereby given to materials, supplies, equipment, machinery and provisions produced, manufactured, supplied or grown in Wyoming, quality being equal to articles offered by competitors outside of the State. The Contract Documents may be examined at the Saratoga Town Hall, 110 E. Spring Avenue, Saratoga, Wyoming 82331.
